OVERVIEW
Welcome to Radiate. The terms “we”, “us”, and “our” refer to Radiate. We operate this website and store, along with all related content, features, tools, products, and services (the “Services”). Radiate is powered by Shopify, which enables us to provide these Services.

These Terms of Service (“Terms”) describe your rights and responsibilities when using our Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy . If you do not agree, you must stop using the Services.

SECTION 1 – ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your state or province of residence. You agree that all information you provide (email, billing, payment, shipping, account details) is accurate, complete, and current.
You are responsible for maintaining the confidentiality of your account and any activity under it. We may suspend or terminate accounts with inaccurate, incomplete, or fraudulent information.
Account sharing, transfer, or resale is not permitted.

SECTION 2 – OUR PRODUCTS
We make every effort to display and describe products accurately. Slight variations in scent, color, or texture may occur due to the handmade nature of our products and device differences.
We do not guarantee that products will meet personal expectations. Product descriptions, pricing, and availability may change without notice. We may limit quantities or discontinue products at our discretion.

SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase. We may accept, modify, or decline orders at our sole discretion. Orders are accepted only after payment is successfully processed.
To protect against fraud, we may request identity verification or cancel orders that appear suspicious, incomplete, or inconsistent.
Cancellations after acceptance may not be possible. Refunds or returns apply only according to our Refund Policy .
All purchases are for personal use only and not for resale.

SECTION 4 – PRICES AND BILLING
Prices listed are inclusive of applicable taxes and exclusive of shipping charges, unless otherwise stated.
Pricing, promotions, and discounts may change without notice.
You agree to provide accurate billing information and authorize us or our payment partners to charge your payment method for all orders.
We may cancel any order that appears fraudulent or unauthorized.

SECTION 5 – SHIPPING AND DELIVERY
Shipping timelines are estimates only. Once an order is handed to the courier, responsibility for delivery lies with the carrier. Title and risk of loss transfer to you at that time.
We are not responsible for delays caused by courier partners, weather, customs, operational issues, or incorrect addresses provided by the customer.

SECTION 6 – CANDLE SAFETY AND CUSTOMER RESPONSIBILITY
Our products include open-flame items such as candles. By purchasing and using our candles, you agree to follow standard candle safety practices, including but not limited to:
• Never leaving a burning candle unattended
• Keeping candles away from flammable materials, pets, and children
• Placing candles on a stable, heat-resistant surface
• Keeping the wick trimmed as recommended
• Avoiding burning for longer than the recommended burn time
• Discontinuing use when only ½ inch of wax remains
Radiate is not responsible for any damage, injury, or loss resulting from improper use, negligence, or failure to follow candle safety instructions provided on our packaging, labels, or website.
Use of our candles is at your own risk, and by purchasing, you accept full responsibility for safe usage.

SECTION 7 – INTELLECTUAL PROPERTY
All content on the Services, including text, images, logos, packaging, product names, and designs, is the property of Radiate or its licensors.
You may use the Services for personal, non-commercial purposes only. Copying, reproducing, distributing, or misusing our content without permission is prohibited.

SECTION 8 – OPTIONAL TOOLS
We may offer access to third-party tools on an “as is” basis. Your use is at your own risk and subject to the provider’s terms.

SECTION 9 – THIRD-PARTY LINKS
We are not responsible for third-party websites linked from our Services. Review their policies before engaging in transactions. We are not liable for any harm or damages arising from third-party interactions.

SECTION 10 – RELATIONSHIP WITH SHOPIFY
Radiate is powered by Shopify, but all sales are directly between you and Radiate. Shopify is not responsible for any aspect of your transactions.

SECTION 11 – PRIVACY POLICY
Your personal information is handled according to our Privacy Policy and Shopify’s Privacy Policy. By using the Services, you consent to these policies.

SECTION 12 – FEEDBACK
By submitting reviews, messages, or feedback, you grant Radiate a perpetual, royalty-free license to use such content for improvement or promotional purposes.
You must not submit unlawful, misleading, defamatory, or harmful content.

SECTION 13 – ERRORS AND INACCURACIES
We may correct errors or update information at any time without notice. We may cancel orders affected by inaccuracies.

SECTION 14 – PROHIBITED USES
You may not use the Services for: unlawful activities; harassment or abuse; impersonation; false chargebacks or refund abuse; fraud or scams; hacking or tampering; scraping; automated misuse; or any harmful or misleading behavior.
We may suspend or terminate accounts violating these rules.

We may terminate access at any time for violations of these Terms. Relevant clauses survive termination.

SECTION 16 – DISCLAIMER OF WARRANTIES
The Services and products are provided “as is” without warranties except those explicitly stated.

SECTION 17 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Radiate is not liable for indirect, incidental, or consequential damages, including loss of data, profits, or property.

SECTION 18 – INDEMNIFICATION
You agree to indemnify Radiate against any claims arising from misuse of products, breach of these Terms, or violation of law.

SECTION 19 – SEVERABILITY
If any provision is unenforceable, the remainder will continue in effect.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT
Failure to enforce any clause does not waive our rights. These Terms constitute the full agreement between you and Radiate.

SECTION 21 – ASSIGNMENT
You may not assign rights under these Terms without our consent. We may assign them without notice.

SECTION 22 – GOVERNING LAW
These Terms are governed by the laws of India.

SECTION 23 – CHANGES TO TERMS
We may update these Terms at any time by posting changes. Continued use indicates acceptance.
